TERMS OF SERVICE

OVERVIEW
This website is operated by Residence Supply (“Residence Supply”, “we”, “us”, “our”). By visiting our site and/or purchasing from us, you engage in our “Service” and agree to be bound by these Terms & Conditions (“Terms”), including policies referenced herein and/or available by hyperlink. Our store is hosted on Shopify Inc., which provides the e-commerce platform we use to sell products and Services to you.

 


 

SECTION 1 – ONLINE STORE TERMS

1.1 Eligibility. You confirm you are of the age of majority in your jurisdiction, or you have parental consent for any minor dependents who use the site.
1.2 Lawful Use. You will not use the Service for any illegal purpose or violate any laws in your jurisdiction.
1.3 No Malware. You must not transmit worms, viruses, or harmful code.
1.4 Immediate Termination. Breaches may result in immediate termination of Services.
 

 


 

SECTION 2 – GENERAL CONDITIONS

2.1 Right to Refuse. We may refuse service to anyone at any time for any reason.
2.2 Transfers Over Networks. Content (excluding credit card data) may be transferred unencrypted over various networks and adapted to technical requirements; payment data is always encrypted during transfer.
2.3 No Commercial Exploitation. You may not reproduce, sell, resell, or exploit any part of the Service without our express written permission.
2.4 Platform Notice. Shopify hosts our store.

 


 

SECTION 3 – PAYMENT POLICY

3.1 Accepted Methods. We accept Visa, MasterCard, American Express, Discover, Apple Pay, Google Pay, PayPal, and Shopify Pay.
3.2 Immediate Authorization & Capture. Payment is processed immediately upon order placement; a confirmation email is sent.
3.3 Security. Transactions use SSL encryption and Shopify’s secure payment processing.
3.4 Pricing & Currency. All prices are listed in USD. Any currency conversion is handled by your financial institution.
3.5 Taxes & Duties. Florida sales tax applies to qualifying orders; international customers are responsible for import duties, customs, and local taxes.
3.6 Invoicing. An electronic invoice is provided after successful payment.
3.7 Order Changes/Cancellations. Email help@residencesupply.com within 12 hours to request a change/cancellation; if already processed, our Return Policy applies.
3.8 Declined Payments. If a payment is declined, verify details/funds and contact your bank if needed.
3.9 Chargebacks & Disputes. You agree not to file a chargeback until you first (a) contact us to attempt resolution and (b) allow us to investigate shipping/defect claims. We may contest improper chargebacks and seek recovery of related fees.
3.10 Third-Party Terms. Use of PayPal, Apple Pay, Google Pay, or other providers is subject to their terms.

 


 

SECTION 4 – SHIPPING POLICY

4.1 Handling Time & Cutoff. Standard handling time is 3 business days; order cutoff is 5:00 PM EST.
4.2 Methods & Timeframes.
(a) Standard Free Shipping: 15–20 business days after order.
(b) Priority Processing + Free Shipping: 10–20 business days after order (expedited production).
4.3 Made to Order. Products enter a production queue; intricate designs may need additional time. Tracking can appear delayed while we craft your item.
4.4 Address Accuracy. You must provide accurate shipping details; we are not responsible for lost/unclaimed parcels due to incorrect addresses.
4.5 Damage Protection (Optional). For $9.95, shipping protection can be added during checkout; if loss/damage occurs with protection, we’ll replace after claim approval. Fee is non-refundable.
4.6 International Shipping. We ship to 120+ locations worldwide; customs duties/taxes may apply and are your responsibility.
4.7 Delays. Couriers may experience delays due to weather, holidays, operational issues, or customs processes.
4.8 Risk of Loss & Title. Unless prohibited by law, title and risk transfer to you upon our delivery of goods to the first carrier (FOB shipping point). For EU/UK consumers, risk passes on actual delivery to you per mandatory law.
4.9 Delivery Issues. If tracking shows “delivered” but you haven’t received it, check alternate locations and contact the carrier; then contact us to investigate.

 


 

SECTION 5 – PRODUCTS OR SERVICES

5.1 Availability. Some items are available exclusively online and may be limited in quantity; returns/exchanges follow our Return Policy.
5.2 Display Accuracy. We attempt accurate imagery but cannot guarantee color accuracy on all screens.
5.3 Right to Limit/Discontinue. We may limit sales by person/region and discontinue products at any time.
5.4 Specs & Tolerances. As many items are handcrafted, minor variations (finish, patina, dimension tolerances) are normal and not defects.

 


 

SECTION 6 – ACCURACY OF BILLING & ACCOUNT INFORMATION

6.1 Order Review. We may refuse or limit orders per customer, account, credit card, or address; we may notify you via the email/phone provided.
6.2 Accurate Info. You agree to provide current, complete, and accurate account and payment info and promptly update it.
6.3 Anti-Fraud. Orders may be screened for fraud; we may request identity/address verification if risk is detected.

 


 

SECTION 7 – OPTIONAL TOOLS

Access to third-party tools is provided “as is” and “as available,” without warranties or endorsements. Use is at your own risk.

 


 

SECTION 8 – THIRD-PARTY LINKS

We are not responsible for third-party content, products, or services; review their policies before transacting.

SECTION 9 – USER COMMENTS, FEEDBACK & OTHER SUBMISSIONS

You grant us a nonexclusive, worldwide, royalty-free license to use, edit, publish, and distribute any voluntary content you submit (such as reviews, testimonials, comments, suggestions, or other creative materials) in any medium, without restriction.

This license does not apply to your personal or transactional information (such as your shipping address, billing address, email, or phone number). Those details are collected only for order fulfillment and customer service and are handled in accordance with our Privacy Policy (Section 10). We do not sell or publicly share your contact or shipping details.

You agree not to submit unlawful, defamatory, offensive, or harmful material (including malware). We may remove or edit submissions at our discretion, and we are not liable for user-generated content.

 


 

SECTION 10 – PRIVACY POLICY (GDPR + CCPA/CPRA)

10.1 Categories of Data. We collect: (a) Device Information (IP address, browser, time zone, cookies/pixels, log files) and (b) Order Information (name, billing/shipping address, payment info, email, phone).
10.2 Purposes. Fulfillment (process payments, arrange shipping, provide invoices/confirmations), fraud screening (notably by IP), customer support, analytics, and—if consistent with your preferences—marketing/ads.
10.3 Legal Bases (GDPR). Performance of a contract, legitimate interests (fraud prevention/analytics), compliance with legal obligations, and consent (where required for marketing/cookies).
10.4 Sharing. We share personal data with service providers (e.g., Shopify, Google Analytics, ad networks) and as required by law (e.g., subpoenas). See Google’s privacy descriptions and opt-out tools referenced in your current policy.
10.5 Behavioral Ads. We use targeted advertising and cross-site analytics; opt-out options are provided (e.g., DAA/NAI tools).
10.6 “Sell”/“Share” (CCPA/CPRA). Where advertising cookies are used, some data may be considered a “sale” or “share.” California residents may opt out of the sale or sharing of personal information via a “Do Not Sell or Share My Personal Information” mechanism (provide link in your footer).
10.7 Your Rights.

  • GDPR (EU/UK/EEA): access; rectification; erasure; restriction; portability; object to processing; withdraw consent; lodge a complaint with your local authority.

  • CCPA/CPRA (California): know/access; delete; correct; opt out of sale/share; limit use of sensitive personal info; non-discrimination.
    Submit requests to help@residencesupply.com. We will verify identity and respond within statutory timelines.
    10.8 International Transfers. When transferring data outside the EEA/UK/Switzerland (e.g., to the U.S.), we rely on appropriate safeguards (e.g., Standard Contractual Clauses and UK Addendum).
    10.9 Data Retention. We retain Order Information for our records unless and until you request deletion.
    10.10 Do Not Track. We do not alter data practices upon receiving a browser DNT signal.
    10.11 Children. Our services are not directed to children under 13 (or 16 in certain jurisdictions). We do not knowingly collect their data without verifiable consent.

SECTION 11 – COOKIE POLICY & DATA PROTECTION ADDENDUM

11.1 Cookies & Similar Tech. We use cookies, pixels, tags, and SDKs for site functionality, analytics, personalization, and advertising.
11.2 Consent (EU/UK). We obtain consent for non-essential cookies; you may withdraw consent via a Cookie Preferences tool. Essential cookies cannot be disabled.
11.3 Categories. Strictly necessary; performance/analytics; functionality; advertising.
11.4 Controls. Browser settings, ad industry tools (META/NAI), and mobile OS settings can limit tracking; full blocking may impair site functionality.
11.5 International Processing. Third-party processors may process data globally under appropriate safeguards (see Section 10.8).
11.6 Addendum (Processors). We engage processors (e.g., Shopify, payments, analytics, logistics) under written contracts that require confidentiality, security, and GDPR-compliant processing on our instructions.

 


 

SECTION 12 – RETURN & REFUND POLICY

12.1 Return Window. You have 14 days from delivery to initiate a return/exchange via our portal (link on site).
12.2 Return Shipping. You generate and pay for the return label unless the item is defective/covered by warranty; if covered, we provide the label.
12.3 Condition. Items must be securely packed; damage during return transit may void the return.
12.4 Damages/Issues. Report damages through the portal with photos/videos; we may offer a replacement or component if approved.
12.5 Non-Returnable. Customized items are non-refundable due to their custom nature.
12.6 Non-Receipt. If you haven’t received your package within 60 business days, contact us for a full refund (address errors excluded).
12.7 Restocking Fees. Non-defective returns may incur up to a 50% restocking fee; open-box items are non-returnable (spares provided if parts are missing).
12.8 Refund Timing. After approval/receipt, refunds are issued in 3–10 business days; banks may need extra time to post.
12.9 Warranty. Standard manufacturer-defect warranty is 30 days; extended warranties are available (see Section 23).
12.10 Cancellations. Orders can be canceled only before shipment (usually 1–2 days after the order). After shipment, use the return process.
12.11 Refused/Unclaimed Parcels. If a parcel is returned to us, the refund (less applicable fees) will be processed after the warehouse receipt.
12.12 EU Consumer Right of Withdrawal. If you are an EU consumer, you may have a 14-day statutory right to withdraw from most online purchases; custom-made goods are excluded by law.

SECTION 13 – PROHIBITED USES

In addition to other prohibitions, you must not: (a) break the law; (b) solicit unlawful acts; (c) violate regulations; (d) infringe IP; (e) harass/abuse/defame; (f) submit false information; (g) upload malware; (h) collect/track others’ personal info; (i) spam/phish/crawl/scrape; (j) act obscenely; (k) bypass security; or (l) perform high-volume automated access that degrades Service.

 


 

SECTION 14 – DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

The Service and products are provided “as is” and “as available” without warranties except as required by law. We do not guarantee uninterrupted, timely, secure, or error-free Service; we are not liable for indirect, incidental, consequential, or punitive damages. Where limits are not allowed, our liability is capped to the maximum permitted by law.

 


 

SECTION 15 – INDEMNIFICATION

You will indemnify, defend, and hold harmless Residence Supply and its affiliates, officers, directors, employees, agents, licensors, and suppliers from claims and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, violation of the law, or misuse of the Service.

 


 

SECTION 16 – SEVERABILITY

If any provision is unlawful or unenforceable, it will be enforced to the fullest extent possible, and the remainder will continue in effect.

 


 

SECTION 17 – TERMINATION

We may suspend or terminate access at any time if you breach these Terms; you remain liable for amounts due up to termination. You may stop using the site at any time.

 


 

SECTION 18 – ENTIRE AGREEMENT

These Terms (and policies incorporated by reference) constitute the entire agreement between you and us and supersede prior agreements. Ambiguities are not construed against the drafting party.


 

SECTION 19 – GOVERNING LAW, CHARGEBACKS & DISPUTES

19.1 Governing Law.
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict of laws.

19.2 Informal Resolution First.
You must first contact us at help@residencesupply.com within 30 days of the issue to attempt resolution. You agree not to initiate a chargeback, arbitration, or other legal proceeding until you have given us this opportunity.


19.3 Chargebacks & Payment Disputes.
(a) By completing checkout, you expressly acknowledge and agree to these Terms & Conditions via a required consent mechanism. Such consent is recorded as part of your order record (including timestamp, version of Terms agreed, IP address, device/browser information, and order attributes).

(b) You agree not to file a payment dispute or chargeback with your financial institution unless you have first followed Section 19.2. Improper chargebacks may be contested and we may recover related fees, costs, or penalties.

(c) In the event of a dispute, we may submit as evidence:

  • Proof of your agreement to these Terms (checkbox consent logs, order metafields, timestamp, IP/UA).

  • Fulfillment records (tracking history, quality control images, supplier confirmations, and proof of delivery).

  • Carrier delivery scans and, where applicable, signature confirmation.

  • Customer communications and product listing records.

  • For claims of product damage, you must provide clear photographs and/or video showing both the damaged product and its original packaging. Without such evidence, we may be unable to process your claim.

(d) For orders over USD $2,000, additional safeguards apply, including signature-required delivery, QC documentation, and shipment insurance.



19.4 Arbitration & Venue.
Except where prohibited by law, disputes will be resolved by binding arbitration on an individual basis under the AAA Consumer Arbitration Rules in Miami-Dade County, Florida. Either party may seek injunctive relief in a court of competent jurisdiction for intellectual property rights or unauthorized use.

19.5 Class Action & Jury Waiver.
To the extent permitted by law, you waive the right to participate in class actions, consolidated claims, or jury trials. Disputes must be brought in your individual capacity only.

19.6 EU/UK Consumers.
If you reside in the EU/UK, mandatory consumer laws and courts of your domicile may apply; arbitration and class action waivers may not apply to you.



 


 

SECTION 20 – CHANGES TO TERMS

We may update these Terms by posting changes on the site; continued use after posting constitutes acceptance.

SECTION 22 – SMS/MMS (TEXT) MARKETING TERMS

22.1 Consent. By providing your mobile number during checkout, subscription forms, or keywords, you consent to receive recurring SMS texts (order updates, cart reminders, promotions). Consent is not a condition of purchase.
22.2 Opt-Out/Help. Reply STOP to unsubscribe; HELP for assistance. Message/data rates may apply; message frequency varies and will not exceed reasonable levels.
22.3 Carriers Not Liable; Short Code Changes. Wireless carriers are not liable for delayed/undelivered messages; we may change short codes/phone numbers upon notice.
22.4 Your Responsibility. Keep your number current; if you change numbers, re-subscribe to continue receiving messages.

 


 

SECTION 23 – WARRANTIES & EXTENDED PROTECTION

23.1 Standard Warranty.
Fixtures carry a 30-day manufacturer-defect warranty; contact support with evidence for replacement. Warranty remedies are provided by supplying the necessary spare part(s) rather than replacing the entire product. For example, if a light bulb or a single component fails, only that part will be shipped, not the full fixture.

23.2 Extended Warranty (Optional).
12/36/60-month plans cover manufacturer and component protection and accidental damage that renders the product inoperable (bulbs excluded). For covered events, we will provide replacement spare parts or components to restore full function. A complete replacement product will only be issued if repair by spare parts is not reasonably possible. Any electrician, installer, or third-party service costs related to the replacement are the customer’s sole responsibility and are not covered under the warranty.

23.3 Exclusions.
Wear/tear, improper installation, misuse, unauthorized repairs, and cosmetic variations consistent with handcrafted processes are excluded.

SECTION 24 – PRODUCT SAFETY, CARE & INSTALLATION

24.1 Compliance.
Electrical products must be installed per local building/electrical codes by qualified personnel.

24.2 Customer Duty.
Verify compatibility (e.g., voltage, box type) before installation; damage from incorrect installation is excluded from warranty.

24.3 Product Care & Maintenance.
For proper care and to extend the life of your fixture:

  • Clean using only a soft microfiber cloth to prevent scratches and damage caused by dust or abrasive materials.

  • Avoid harsh cleaning agents, solvents, or abrasive pads.

  • Do not expose fixtures to direct or prolonged sunlight, as it may cause fading, warping, or surface deterioration.

  • Regular light cleaning is recommended to maintain finish quality.

     

 


 

SECTION 25 – EXPORT, SANCTIONS & GEOGRAPHIC RESTRICTIONS

You agree to comply with all applicable export controls and sanctions. You may not purchase or use products in prohibited territories or for prohibited end-uses.

 


 

SECTION 26 – FORCE MAJEURE

We are not liable for delays/failures caused by events beyond our reasonable control (e.g., natural disasters, labor disputes, epidemics, carrier failures, government actions).

 


 

SECTION 27 – ASSIGNMENT

We may assign these Terms (in whole or part) without notice in connection with a merger, acquisition, asset sale, or by operation of law. You may not assign without our written consent.
 

 


 

SECTION 28 – NOTICES & ELECTRONIC COMMUNICATIONS

You consent to receive notices electronically (email, site postings). Keep your contact details current. Legal notices to us must be emailed to help@residencesupply.com and mailed to our Miami address.

 


 

SECTION 29 – PRICES, PROMOTIONS & ERRORS

Prices and promotions may change without notice; we may correct errors, inaccuracies, or omissions (including after order submission) as permitted by law.
 

 


 

SECTION 30 – PROGRAM-SPECIFIC TERMS (Membership/Wholesale/Affiliate)

If you join our Members Program, Wholesale Program, or Affiliate Program, additional program-specific terms apply (presented at enrollment). In any conflict, program terms control for that program.
